Thank you for choosing Zdorovyak. Our mission is to create clear and convenient tools so that you can easily build your own websites, optimize product catalogs, and also design smart chatbots, robots, and AI agents for your tasks.
To use Platform services, you must review this User Agreement (the "Agreement") and accept its terms. This document forms a legally binding agreement between Individual Entrepreneur Demidov Evgeny Vladimirovich (the "Administration") and the person using the Platform (the "User"). By clicking the "Register" button on the Website or in the Mobile Application, the User expresses full and unconditional acceptance of all Agreement terms (offer acceptance).
Terms and Definitions
Platform means a software complex available at https://zdorovyak.com/, https://da.zdorovyak.com/, https://ai.zdorovyak.com/, https://xml.zdorovyak.com/, https://my.zdorovyak.com/ (including other Website subdomains), and in the "Zdorovyak" mobile application, intended for creating websites, optimizing product catalogs, and for developing, configuring, and launching chatbots, robots, and agents (including those based on artificial intelligence), as well as call / SMS booking and admin services.
Account (Personal Dashboard) means the User's personal account on the Platform.
Project means a website, product catalog, chatbot, AI agent, robot, or booking service (including an AI booking administrator) created by the User using Platform functionality.
End User means an individual interacting with a Project (visitor of a created site or chatbot/robot interlocutor).
Content means information, texts, scenarios (prompts), knowledge bases, images, and other materials uploaded by the User to the Platform for Project operation.
Plan means the scope of Platform functionality and services available to the User for a certain fee (or free of charge).
Services means related services provided by the Administration to the User (project hosting, integration operability, etc.).
1. Registration and Account
1.1. To use the Platform, the User must register by providing a valid email address and password.
1.2. All actions performed in the Account are deemed performed by the User personally. The User is solely responsible for safeguarding login and password.
1.3. The Platform is not intended for persons under 18 years of age without consent of legal representatives.
1.4. If the User registers on behalf of a legal entity, the User warrants having all necessary authority to conclude this Agreement on behalf of the company.
2. Platform and Services
2.1. The Administration grants the User a non-exclusive, revocable license to use the Platform for creating and managing Projects according to the selected Plan.
2.2. Specifics of robots and AI agents. The Platform allows configuring algorithms and connecting AI technologies (LLM) to automate communications. The Administration ensures technical connectivity of the Platform but does not guarantee 100% accuracy, correctness, or ethical quality of responses generated by AI within the User's Project.
2.3. Integrations. The Platform allows connecting Projects (robots) to third-party services (Telegram, WhatsApp, VK, etc.). Operability of such integrations depends on third-party service APIs. The Administration is not responsible for failures, rule changes, or blocks by owners of third-party messengers.
2.4. The Administration may at any time modify or update the Platform, and set limits (for example on bot message count, knowledge base size, disk storage) according to Plans.
3. Prohibited Actions and Project Requirements
3.1. The User bears full personal responsibility for Content and operating logic of Projects created by the User (websites and robots).
3.2. Prohibited activity. The User is prohibited from creating Projects that:
3.3. Technical prohibitions. The User is prohibited from attempting to hack the Platform, bypass plan technical restrictions, use parsers, or create Projects causing excessive (DDoS) load on Administration servers.
4. Blocking and Access Restriction
4.1. If Agreement violations are identified or substantiated third-party complaints are received, the Administration may, without prior notice:
4.2. Account blocking for severe violations (spam, fraud) is performed without refund of paid Plan fees.
5. Plans and Payment
5.1. Plans. Platform functionality is provided under the selected Plan. Current Plan pricing and limits are available in the Personal Dashboard or on the Website.
5.2. Auto-payments (Subscription). When paying by bank card, the User agrees to automatic monthly or annual recurring charges for Plan renewal. The User may disable auto-renewal in the Personal Dashboard at any time before the next charge date.
5.3. Non-refundability. Since access to the Platform is considered rendered at Plan activation, fees for an already paid period are non-refundable unless otherwise provided by Russian law.
5.4. B2B payments. Legal entities and individual entrepreneurs may pay by bank transfer based on invoice. Acts (UPD) are provided via electronic document interchange system (EDI) or upon email request.
6. Intellectual Property
6.1. Administration rights. All rights to Platform source code, algorithms, Personal Dashboard design, and interfaces belong to the Administration.
6.2. User rights. All rights to uploaded Content, dialogue scenarios, website texts, and visual materials belong to the User.
6.3. By placing Content, the User grants the Administration a technical license to store, process, and reproduce it solely to ensure Project operation.
6.4. The User may not resell or copy Platform source code or present Zdorovyak technology as its own (White Label) without a separate written agreement with the Administration.
7. Personal Data
7.1. Processing of the User's own personal data is regulated by the Zdorovyak Privacy Policy.
7.2. End User data. If User Projects (sites or robots) collect End User personal data (full name, phone numbers in chats, email addresses), the User is the data controller.
7.3. The Administration acts exclusively as a processor of such data on User instructions (provides server infrastructure). The User must independently obtain all required consents from End Users.
8. Limitation of Liability (Warranties)
8.1. The Platform is provided on an "as is" basis. The Administration does not guarantee that the Platform will meet individual User expectations or operate absolutely without interruption.
8.2. The Administration is not liable for:
8.3. The User undertakes, at its own expense, to settle any third-party claims (including those from state authorities) related to operation of its Projects and indemnify the Administration for any losses caused by such claims.
9. Amendment of the Agreement and Dispute Resolution
9.1. The Administration may unilaterally amend this Agreement. A new version becomes effective upon publication on the Website. Continued Platform use means acceptance of changes.
9.2. Relations between the Parties are governed by the law of the Russian Federation.
9.3. All disputes are subject to mandatory pre-trial (claim) procedure. Response period to a claim is 30 (thirty) calendar days.
9.4. If no agreement is reached, the dispute is referred to a court at the Administration's location unless otherwise established by mandatory law provisions.
